Terms of Service
It means a lot to me that we build a healthy, happy working relationship together. I promise to carry out work for you to the best of my ability, in exchange for you agreeing to respect my terms of service.
Terms & Conditions for Origin website packages
I aim to complete Origin website packages (have the finished website live on your hosting) within 2 weeks of receiving ALL content and information requested. If I cannot complete within this timeframe due to unforseen circumstances (such as illness or injury), I will inform you, and will make it a priority to complete the work in as timely a fashion as possible.
If you miss content deadlines we have agreed, I am not liable for delays to the work. In such cases I will do my best to complete your work as soon as possible, but we will need to agree a new timeline.
When you purchase the Origin website package, you are agreeing to provide me with alternative content to replace the sample content shown in the Origin example website. This is purely a content replacement service, and does not include any additional website design or website editing.
If you choose to have a blog page set up, the service includes setup of up to THREE blog posts. Additional blog posts pay be added upon request for additional cost.
The service does not include migration of any existing website pages, or blog posts.
For single instalment payment plans, the full cost of service must be received before I will commence work.
For two instalment payment plans, the first instalment must be received before I will commence work. The second payment will be payable exactly one month after the first payment.
Failure to make payments may result in work being witheld, and potentially legal action.
See your invoice for payment details.
I’ll carry out my work in accordance with good industry practice. That said, I can’t guarantee that my work will be error-free and so I can’t be liable to you or any third party for damages, including lost profits, lost savings or other incidental, consequential or special damages, even if you’ve advised me of them.
It is your responsibility to seek legal advice and ensure your website and business meets UK, EU or any other legal standards.
You guarantee that all elements of text, images or other artwork you provide are either owned by your good self, or that you have permission to use them. When you provide text, images or other artwork to me, you agree to protect me from any claim by a third party that I’m using their intellectual property.
I guarantee that all elements of the work I deliver to you are either owned by me or I’ve obtained permission to provide them to you. When I provide text, images or other artwork to you, I agree to protect you from any claim by a third party that you’re using their intellectual property.
Intellectual property rights
I (Rhiannon Adler) own the intellectual license rights to the design of both the Origin website child theme and the Origin brand (fonts, logo and colour scheme). I withhold the rights to distribute the Origin website child theme and the Origin brand to other clients.
By purchasing the Origin website package, I am granting you license to use the website theme on any websites owned by you, and edit it in whatever what you see fit. You are free to alter any element.
You cannot distribute the Origin theme for commercial or non-commercial purposes.
If you choose to use the Origin branding for your website, I will create a Wordmark logo using your Business name in the style of the existing logo on the example website here:
I will send this to you in eps, png and jpg formats for you to use elsewhere, along with the two fonts used on the Origin website (Passionfruits and Montserrat) and information on the 5-colour scheme including hex codes, RGB codes and CMYK codes.
I maintain ownership of the Origin brand, and reserve the right to continue to distribute it to other customers. You are not permitted to distribute or sell the Origin brand to others.
If you choose to use the Origin branding, I will transfer to you a license to use the Passionfruits font, purchased from Creative Market. This will be licensed as a webfont ONLY, and will be valid for use on your website up to 10,000 visitors per month. It does not include a desktop license, but you can purchase an additional license for desktop, e-publishing, apps, or increased webpage viewings directly from Creative Market at the following page:
You can view full terms of the Passionfruits font license here:
Montserrat is a free Google font, licensed under the Open Font License. You can use it freely in your print or digital commercial products. See the license for further details.
The service does not include any design amendments to any part of the branding.
I own unlimited lifetime access to the Divi Theme as owned by Elegant Themes, and I use my own API key on your website to allow you access to my full developer privileges on ONE website. I allow you the right to continue using my license on one website for as long as I have access to it and you are using the design created by me.
If I cease business, your access to my Divi Theme License will remain. However, I am not responsible for any problems arising if the Elegant Themes Terms of Service change, or Elegant Themes ceases business, and your access is limited or removed.
I do not guarantee any improvement to a search engine ranking, nor can I promise to get a site higher up or to the ‘top of Google’, but I build every site in a way that is accessible to search engines in an effort to increase its chances. I am not responsible for any loss of search engine rankings or subsequent loss of business brought about by the work carried out. I will install the Yoast SEO plugin, and will provide instructions on its basic use in the client area on my website.
Hosting, domains & support
The Origin website package does not include website hosting, domains, support, or the management of any of these services. Assistance may be provided at my discretion for an additional fee.
I am not responsible for the continued maintenance and updating of your website, including but not limited to, the theme, plugins, WordPress, SSL certificates, hosting, domains and email. You can hire me to run updates in future if needed, at hourly rates.
